1.2. Personal Data – information concerning an individual who is or can be identified by one or a few specific factors which define physical, psysiological, genetic, mental, economic, cultural or social identity, including IP of the device, Internet identifier as well as information accumulated through cookie files or similar technology.

1.3. Policy – this Privacy Policy.

1.4. GDPR – REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 Apriril 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)

1.5. Website – website run by the Controller under www.rekeep.pl

1.6. User – any individual who visits the Website or who uses one or more services or functionalities described in the Policy.

  1. Processing of personal data related to the use of the Website

2.1. Due to the fact that the User uses the Website, the Controller collects the data within the scope which is indispensable for providing individual services he offers. Detailed rules and objectives for processing Personal Data collected when the User uses the Website are described below.

  2. A) Use of the Website

3.1. Controller processes Personal Data of all the people using the Website:

3.1.1. with the objective of providing services through electronic channels within the scope of making the content collected on the Website available to Users – in such a case legal basis for processing can be found in it being necessary for performing the Contract  (Article 6.1.b of GDPR);

3.1.2. with the objective of determining and pursuing claims or protecting against such claims  - legal basis for processing can be found in the legitimate interests pursued by the Controller (Article 6.1.f of GDPR) in order to protect such rights.

  1. B) Contact Form

3.2. Controller ensures the possibility to contact him by making use of electronic contact form. Making use of this form requires the User to submit Personal Data necessary to contact the User and to reply to his query. User can also submit other data in order to faciliate the contact or the handling of query. Submitting the data marked as obligatory is necessary for accepting and handling the query, and refusal to submit them results in the lack of possibility of handling such a query. Submitting other data is voluntary.

3.3. Personal data are processed with the objective of identifying the sender and handling his query sent through available contact form - legal basis for processing can be found in the fact that such processing is necessary for the performance of a contract for providing a service (Article 6.1.b of GDPRR); as far as the data submitted voluntarily are concerned, the legal basis for their processing can be found in a given consent (Article 6.1.a of GDPR.)

  1. C) Marketing

3.4. Personal data of the User can also be used by the Controller in order to direct marketing content to him through various channels i.e. through e-mail, through MMS/SMS. Controller performs such actions solely if the User consented to them, and such consent can be revoked at any moment.

3.5. Personal data are processed:

3.5.1. with the objective of sending the ordered commercial information - legal basis for processing, including such processing which uses profiling, can be found in the fact that such processing is necessary for the purposes of the legitimate interests pursued by the Controller (Article 6.1.f of GDPR) with reference to a given consent;

3.5.2. with the analytical and statistical objectives  - legal basis for processing, including such processing which uses profiling, can be found in the fact that such processing is necessary for the purposes of the legitimate interests pursued by the Controller (Article 6.1.f of GDPR) which entails conducting analysis of the way Users act on the Website in order to improve the functionalities used.

  1. Cookie files

4.1. The Cookies mechanism is not used to obtain any information concerning users of the Website or to track their navigation. Cookies files used on the Rekeep Polska website do not store any personal data or other information collected from users.

The www.rekeep.pl website can periodically use session cookie file named INFO – to record the fact of the user familiarising himself with the highlighted information. The cookie file is created in order to limit the volume of periodically shown advertisments. Thanks to using this cookie file, this information is shown only once during the user’s session and it is not shown again after moving to another part of the Website. The session cookie file mentioned above, if created, appears only during a defined time period and only during the time when the user visits the Website. Once the user closes the web browser’s window, the created file is erased.

  1. Period of the processing of personal data

5.1. Period during which the Controller processes the data depends on the type of service he provides as well as on the objective of such processing. By rule, the data are processed during the time of service provision, until the expressed consent is revoked, reporting effective objection to the data being processed in cases when legitimate interest of the Controller constitutes the legal basis for such processing.

5.2. Period during which the Controller processes the data can be prolonged when processing is necessary for determining and pursuing potential claims or for protection against claims, and after such period solely in cases and scope required by legal regulations. Once the period during which the Controller processes the data is over, the data is irrevocably removed or anonimized.

  1. Competences of the User

6.1. The User has the right to access his personal data, to rectify, erase them and restrict their processing as well as to transfer his personal data. The User also has the right to file a complaint to the President of the Personal Data Protection Office

6.2. The User also has the right to raise objection against his data being processed on the basis of the legitimate interest of the Controller.

6.3.  As far as the User’s voluntary data are processed, such a consent can be revoked at any time by contacting the Controller through the dedicated contact form made available on www.rekeep.pl

  1. Recipients of the personal data

7.1. With reference to service provision, personal data will be disclosed to external entities, including particularly IT services providers which allow for the correct use of the Website.

7.2. If the User consents, his data may be disclosed to other entities for their own purposes, including marketing ones.

7.3. The Controller reserves the right to disclose selected User-related information to competent entities or third party which will demand such information, based on the correct legal basis and in accordance with current legal regulations.

  1. Transferring personal data outside EEA

8.1. Level of personal data protection outside European Economic Area (EEA) differs from the one guaranteed by European law. Due to this reason the Conttroller transfers personal data outside EEA only when necessary and with the proper degree of protection ensured, particularly through:

8.1.1. cooperating with entities which process Personal data in countries with reference to which the European Commission have issued applicable decision confirming the guarantee of the proper degree of personal data protection;

8.1.2. applying the standard contract clauses issued by the European Commission;

8.1.3. applying the binding corporate rules approved by the competent supervisory body.

8.2. The Controller always informs about his intent to transfer Personal data outside EEA when collecting them.

  1. Safety of the personal data

9.1. The Controller conducts continuous risk analysis in order to ensure such a situation in which he processes Personal data in a safe manner – thus ensuring that only the authorised persons can access them and only within the scope which is necessary for tasks which they perform. The Controller pays utmost attention for all operations concerning Personal data to be recorded and performed only by authorised employees and associates.

9.2. The Controller undertakes all actions necessary in order for also his subcontractors and other cooperating entities to ensure the fact of applying proper safety measures in each case when they process Personal data as requested by the Controller.
